These Terms of Service ("Terms") govern your access to and use of NotaryoPH and the remote online notarization services we facilitate. We are a Philippines-based technology platform that connects clients with duly commissioned Philippine notaries who perform notarial acts in accordance with the 2004 Rules on Notarial Practice (RNP), A.M. No. 24-10-14-SC (Rules on Remote Online Notarization), and all applicable Supreme Court circulars and issuances.
NotaryoPH is a technology platform that connects users with commissioned notaries public for remote online notarization services.
WE ARE NOT A LAW FIRM. We do not provide legal advice, legal representation, or legal services.
The notaries using our platform are independent professionals licensed by the Supreme Court of the Philippines. Each notary is solely responsible for:

By creating an account, scheduling, paying for, or joining a remote notarization session, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy.
We may update these Terms at any time to reflect legal, technical, or operational changes. We will notify you of material changes via email or platform notice. Changes become effective upon posting or on the date specified. Continued use after updates constitutes acceptance.

By using our services, you represent that you are of sound mind, acting voluntarily and without duress, and understand the document you are signing. The notary will assess your capacity during the session and may refuse notarization if you appear to lack capacity.
Notaries using the platform must hold a valid notarial commission issued by the Executive Judge of the Regional Trial Court having jurisdiction, and must comply with geographic and practice limitations in their commission and in applicable Supreme Court rules.
You agree to:
You are responsible for all activity under your account. Never share your account credentials. We are not liable for losses due to unauthorized account use resulting from your failure to maintain credential security.
We may suspend or terminate your account if you violate these Terms, provide false information, engage in suspected fraudulent activity, or as required by law or competent authority.
NotaryoPH provides remote online notarization services in strict compliance with:
All notarial acts are performed by duly commissioned notaries public licensed in the Philippines and authorized to perform remote notarization under Supreme Court rules.
In compliance with Supreme Court rules, your identity will be verified through multi-factor authentication methods including:
You must attend the live video session in a stable, well-lit environment with the same ID and documents you submitted. Providing false, altered, or outdated documents is strictly prohibited and may be reported to authorities.
If we cannot verify your identity to the required standard, we cannot proceed with remote notarization. You may attempt verification with alternative identification, schedule in-person notarization with a traditional notary, or contact our support team for assistance.
In compliance with A.M. No. 24-10-14-SC, all remote notarial acts are recorded via audio-visual communication. By using our services, you consent to:
Recordings are confidential and accessible only to the notary who performed the act, you (upon request), the Executive Judge for notarial compliance review, and law enforcement or courts pursuant to lawful order.
Certain documents may NOT be eligible for remote notarization under Supreme Court rules, including but not limited to:
The notary may refuse, suspend, or terminate the session if identity, voluntariness, or document integrity cannot be confirmed, or if the act would violate law, professional obligations, or Supreme Court rules.
If you attempt to notarize an excluded document, your request will be declined. For these documents, please seek in-person notarization from a commissioned notary public.
You are solely responsible for:
The notary will NOT review your document for legal sufficiency, advise you on document content, guarantee your document will be accepted by third parties, or ensure your document achieves your desired legal outcome.
You may NOT use NotaryoPH to:
Violations may result in immediate account termination, refusal of service, reporting to law enforcement, civil or criminal liability, and reporting to the Supreme Court for notary violations.
All fees are displayed before booking. Notary fees are subject to maximum amounts prescribed by law and Supreme Court rules. We do not charge more than the legally permitted maximum.
Payments cover the platform services and the notary's professional fees where applicable. Unless required by law, confirmed sessions and completed notarizations are non-refundable.
Refund Policy:
Approved refunds will be processed within seven (7) business days to your original payment method.
Under the Electronic Commerce Act of 2000 (Republic Act No. 8792), electronic documents and electronic signatures have the same legal effect as paper documents and handwritten signatures.
The notary's electronic seal and signature affixed to your document comply with Philippine law and have the same legal effect as a traditional notarial seal and signature.
By using NotaryoPH, you consent to:
You may print your electronically notarized document. The printed copy is a true copy of the electronic original.
The platform, including its software, branding, design, interface, and content, is owned by NotaryoPH or its licensors. You may use it solely to access services for which you have registered.
You may not copy, modify, distribute our platform, use our trademarks without permission, or remove copyright or proprietary notices. Reverse engineering, scraping, or unauthorized use of our marks is prohibited.
You retain all rights to documents you upload. By using our platform, you grant us a limited license to process, store, display, and transmit your document solely for the purpose of notarization and as required by law.
Notaries using the NotaryoPH platform are independent contractors, not employees or agents of NotaryoPH.
Each notary:
NotaryoPH does not control or direct the notary's professional judgment or notarial decisions.
TO THE MAXIMUM EXTENT PERMITTED BY PHILIPPINE LAW:
The platform is provided on an "AS IS" and "AS AVAILABLE" basis. NotaryoPH disclaims all warranties of merchantability, fitness for a particular purpose, non-infringement, title, accuracy, reliability, or uninterrupted availability.
NotaryoPH is NOT responsible for:
To the extent allowed by law, our aggregate liability for claims arising out of these Terms or the Services will not exceed the fees you paid for the relevant transaction.
We are NOT liable for indirect, incidental, consequential, special, or punitive damages including lost profits, loss of data, business interruption, or reputational harm.
This limitation does NOT apply to our gross negligence, willful misconduct, violations of data privacy law, fraud, or liability that cannot be limited by law.
For notary-related claims: You must pursue remedies against the notary individually, including filing a complaint with the Executive Judge, the Supreme Court, civil action against the notary, or claim against the notary's surety bond.
You agree to indemnify and hold harmless NotaryoPH, its officers, directors, employees, agents, and licensors from any claim, demand, damage, loss, or expense (including reasonable attorney's fees) arising from:
We may suspend or terminate your access if you breach these Terms, provide false information, compromise platform security, or if required by law or by a competent authority.
You may stop using the Service at any time and request account closure by contacting support. Certain obligations (e.g., payment, indemnity, limitations of liability, data retention requirements) survive termination.
Upon termination, your right to use the platform ceases immediately. We will retain your data as required by notarial law and data privacy regulations.
These Terms are governed by the laws of the Republic of the Philippines.
Any dispute that cannot be resolved amicably will be submitted to the proper courts of Metro Manila, Philippines, to the exclusion of all other venues, without prejudice to mandatory venue rules under Philippine law.
Before filing any legal action, you agree to attempt to resolve disputes through direct negotiation with NotaryoPH by contacting our support team.
If any provision of these Terms is found invalid or unenforceable by a court of competent jurisdiction, the remaining provisions remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and NotaryoPH regarding use of our platform, superseding all prior agreements, representations, or understandings.
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
